Divorce Issues

In Florida, the terms divorce and Dissolution of Marriage are used interchangeably. Florida is a “no-fault” divorce state, which means one does not need to have specific reasons or grounds to justify the end of a marriage. In a Dissolution of Marriage action, parties are required to provide full disclosure and documentation of assets and finances. If the case is a Dissolution of Marriage involving Minor Children, Florida statutes require both parties to attend a parenting class (usually separately) before a divorce can be finalized. The class addresses court procedure regarding parental rights and responsibilities, child support enforcement, and parenting time-sharing. Depending on the circumstances, the distribution of assets and support can often become a major issue in the divorce.

 

A Simplified Dissolution of Divorce is an uncontested divorce and can only be granted if both parties agree on all the divorce terms, there are no minor children, there is full agreement on how to divide assets, if any, and no one is seeking spousal support.

In a Florida divorce or child custody case, the judge will define the children’s best interests when deciding how Parental Responsibility shall be exercised by the parents. Florida child custody laws does not give any preference to mothers or fathers when deciding child custody issues.

Alimony is designed as a tool for courts to require a spouse with greater financial capacity to support a former spouse until he or she is able to establish the ability to support him or herself. Although this tool is being used less and less frequently, it is still available to courts and is often badly needed

The Courts, for the most part, attempt to make sure the divorce case is or was played on a level legal and financial playing field when deciding to award temporary suit fees or award attorney’s fees at the conclusion of the case.
